TERMS OF USE AND PRIVACY POLICIES

1. Legal Information

For the purposes of the provisions of Article 10.1 of the society of information and electronic commerce Act 34/2002 of 11 July 2002, FUNDACIÓN BARCELÓ, a non-profit organization constituted in Palma de Mallorca on October 24, 1989 by virtue of a public deed executed before Notary Public of Palma de Mallorca , Mr. Salvador Balle Oliver, under number 3,016 of his protocol, and registered in Registro del Protectorado de Fundaciones, Ministry of Education and Culture, on July 18, 1990, under number BAL-1-1-3-16 and CIF G-07455868, with registered address in Palma de Mallorca, C/ San Jaime, nº 4 (hereinafter, the PROVIDER). 2. Access and use of the website

The General Conditions of Access and Use governing access to and use of the website www.fundacionbarcelo.org (hereinafter the Website), that PROVIDER offers internet users, whose aim is to provide the user with information on the PROVIDER, its activities and its latest news published.

Access to the Website implies acceptance of these General Conditions of Access and Use, so the Foundation strongly suggests that the User reads these carefully before using the Website. If the User does not agree to these terms, the Foundation suggests that the User refrains from using the Web Site and its contents.

The PROVIDER hereby informs users of this Web Site that these General Conditions of Access and Use may be adapted or modified at any time without notice. Consequently, the User must read and accept the General Conditions of Access and Use in each of the occasions when they want to use the Web Site.

3. Disclaimer

3.1 Operation of the Website

The PROVIDER, in compliance with its standards of quality and comprehensive customer service, continually reviews the published information, using technology and qualified staff, in order to make the best possible effort to ensure that information is accurate and adjusted within the limits of the state of technology; however, on occasion it may contain errors, inaccuracies or any kind of error.

3.2 Changes on the website information.

The PROVIDER reserves the rights, at any time, to amend, modify and/or replace all or part of this website and the information and materials contained on it, as well as its configuration or presentation.

3.3 Use of the information contained in the Website

Both access to the Website and the use made of any information it contains, is under the sole responsibility of the User. The PROVIDER is not responsible for any damages or losses arising directly or indirectly from the access or use of the information contained on the Website and, in particular, the information concerning persons other than the PROVIDER.

4. User responsibility

The user is aware and voluntarily accepts that the use of the website takes place, under their sole and exclusive responsibility. The User is liable for damages of any kind that the PROVIDER may suffer as a result of a breach of any of the obligations to which it is submitted under these General Conditions of Access and Use or applicable law concerning the use of the Website.

5. Intellectual property

All content included on this website, including articles, text, graphics, photographs, images, logos, videos, audios, databases, software, or the web as a whole correspond to BARCELÓ FOUNDATION as the holder of the domain or entitled to use under the third party licensing entity, so its use is prohibited without express permission. The trademarks, trade names, logos and other distinctive signs found on the website are the property of FOUNDATION BARCELÓ, or this entity has the corresponding license for insertion on the web. In the absence of express authorization without prejudice to the above, the user is prohibited to reproduce, distribute, publicly communicate and transform the content and / or marks for commercial purposes or financial gain.

6. Personal Data Protection

The PROVIDER, as controller of the processing of data through the Website, is committed to comply with the legislation in force regarding automated data processing and, in particular, the Organic Act 15/99 on Personal Data Protection of 13 December ( hereinafter LOPD).

In order to contact the PROVIDER through our Web Site, the USER must provide the personal data listed in the form provided for this purpose, or contact the Provider either by e-mail or by telephone on the number provided. This will allow the Foundation to provide a better and more specific service with the following purposes:

  1. Respond to the information provided by the User.
  2. Manage their possible participation in our activities (volunteering, donations, etc.).
  3. In order to sending newsletters.
  4. Conduct surveys and statistics among Users.

In compliance with the Provisions of Organic Act 15/1999, 13 December on Personal Data Protection (LOPD), we do inform the user that in order to contact the PROVIDER, via the Web Site, the User will be requested to provide personal data. The data provided by the user will be stored on a personal data file , owned by the PROVIDER duly registered with the AEPD, and complies with security measures in accordance with the regulations of the LOPD.

In the forms requesting personal data, the User will have detailed information about the purpose of processing and use of such data; as well as the compulsory or optional nature of their responses the consequences of refusing to provide them and, in general, to all the information concerning the applicable legislation on personal data protection, which must be expressly accepted by the User.

The PROVIDER agrees to treat the personal information of Users in accordance with the provisions of applicable law and, in particular, to treat all personal data of the User to which it has access to, as a result of browsing on the website. However, the PROVIDER may disclose personal data and any other information concerning the User whenever it is required by public authorities in the exercise of their legitimate functions, and in accordance with applicable regulations, and in whose charge it will be to take all the technical and organizational security measures necessary to prevent alteration, loss and unauthorized treatment or access to such data. While the PROVIDER shall take technical and organizational measures, given the state of technology, to preserve the security and integrity of personal data and to avoid its alteration, loss, treatment or unauthorized access.

Moreover, pursuant to the provisions of Article 22 of Law 34/2002, of July 11, regarding the Services of the Information Society and Electronic Commerce (LSSICE), the PROVIDER informs the Users of its intention of sending communications to promote our activities via email or any other means of electronic communication. When Users give their contact information for the purpose described here (bulletins and newsletters, information requested on certain activities, etc.), they expressly consent to receive such communications.

The assent here granted by the user regarding data communication is revocable at any time, without retroactive effect. Users may exercise their rights of access, rectification, cancellation and opposition granted by the Data Protection Act by sending a letter addressed, ‘for the attention of the LOPD Committee’, to C / San Jaime 4, 07012, Palma de Mallorca (Spain) in the terms established by the Spanish Agency for Data Protection, indicating that their right is being exercised and enclosing a photocopy of the User’s ID card.

Cookies

The PROVIDER may use cookies when a user browses the Web Site. Cookies are only associated with an anonymous user and its computer, and do not provide references that infer the identity of the user. Thanks to cookies, it is possible that the PROVIDER recognize registered users after they have registered for the first time without having to register each time they access the areas and services reserved exclusively for them. Security

All data query operations regarding the user account, as well as the request of services or products through the website are made through a secure server. The Server’s software encrypts all the information provided before it is transmitted. The website also has strict security procedures regarding the storage and disclosure of data, in order to prevent any unauthorized access, in accordance with the provisions of article 9 of the Organic Law 15/1999 of 13 December, on Protection of Personal Data in force in Spain.

7. Governing Law and Jurisdiction

Access to and use of the Website shall be governed by and construed in accordance with Spanish law. Any dispute arising from the application of these conditions shall be brought in the courts of Palma de Mallorca (Spain), without prejudice to any other jurisdiction that may correspond to the applicant, as provided in the applicable procedural rules.
